This Terms of Service and Privacy Notice (this "Agreement") is a single, integrated agreement comprising two parts: Part A — Terms of Service and Part B — Privacy Notice. Part A governs the products, tools, templates, systems, workbooks, and courses offered or operated by Mental Health Moves LLC, including, but not limited to, Discovery Made Simple, Asset Division Made Simple, Cash Flow Made Simple, Parenting Time Preview, Proof Check, Chaos to Capable, and any current or future products and bundles (collectively, the "Products"). Part B describes MHM's privacy practices, including in connection with the Products, our websites, and our social media channels.
The User should read this Agreement carefully before purchasing, downloading, or using any Product.
Who We Are
The Products are offered and operated by Mental Health Moves LLC, a Wyoming limited liability company ("Mental Health Moves," "MHM," "we," "us," or "our"). Notices and inquiries may be directed to:

Acceptance of this Agreement
The User accepts and becomes bound by this Agreement by either: (a) selecting a checkbox or similar control indicating agreement to this Agreement at checkout or before first use of a Product; or (b) purchasing, downloading, or using any Product. If the User does not agree to this Agreement, the User must not purchase, download, or use any Product.
Acceptance of this Agreement also constitutes the User's consent to the data and analytics practices described in Part B. Mere access to MHM's websites or social media channels, without the affirmative agreement or use described above, does not by itself bind the User to Part A; MHM's data practices applicable to its websites and social media channels are described in Part B.
Important Notice
The Products are practical organizing and preparation tools. They do not constitute legal, financial, or mental health advice, and they do not replace attorneys, mediators, financial professionals, or licensed therapists. Use of the Products does not create an attorney-client relationship or any other professional-client relationship. The full disclaimer appears in Section A.3.
Part A — Terms of Service
A.1 Definitions
In this Agreement, the following terms have the meanings set forth below:
- "Products" means all products, tools, templates, systems, workbooks, and courses, and related materials and services, offered or operated by MHM.
- "Google Drive-Based Tools" means those Products that operate within the User's own Google account and storage.
- "Courses" means MHM's online educational programs.
- "User," "you," or "your" means the individual who accesses, purchases, or uses any Product.
- "Content" means all text, materials, designs, software, and other works made available by MHM through the Products.
- "De-identified Information" means information that cannot reasonably be used to identify, relate to, describe, be associated with, or be linked, directly or indirectly, to a particular User, person, or household. With respect to all De-identified Information, MHM (i) takes reasonable measures to ensure the information cannot be associated with a User, person, or household; (ii) maintains and uses the information only in de-identified form; (iii) does not attempt to re-identify the information; and (iv) requires any recipient of the information, by contract, not to attempt to re-identify it.
A.2 Eligibility and Territory
The Products are intended and offered solely for use within the United States. The Products reference the legal system of the United States and are not designed for use under the laws of any other jurisdiction. The User must be at least eighteen (18) years of age and must have the legal capacity to enter into a binding contract in order to purchase or use any Product. The Products are intended for adults — specifically, parents managing divorce, custody, and related family-law matters — and are not directed to children.
A.3 Nature of the Products; No Professional Advice
The Products are self-help digital tools, templates, systems, workbooks, and educational programs intended to assist the User in organizing information and preparing to navigate a divorce or custody process. The User acknowledges and agrees that:
- (a) MHM does not provide legal advice, legal representation, financial advice, or mental health treatment;
- (b) MHM does not guarantee any legal, financial, custody, settlement, or judicial outcome;
- (c) the Products do not replace attorneys, mediators, financial advisors, or mental health professionals; and
- (d) the accuracy of any output produced by a Product depends entirely on the accuracy and completeness of user-provided information, which MHM does not verify.
Use of the Products does not create an attorney-client relationship or any other professional-client relationship. The User is solely responsible for the User's own decisions and for obtaining qualified professional advice where appropriate.
A.4 License
Subject to the User's compliance with this Agreement, MHM grants the User a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Product the User has purchased or been granted access to, solely for the User's own personal, non-commercial purposes. The User shall not, and shall not permit any third party to:
- (a) resell, sublicense, rent, lease, lend, share, or otherwise distribute any Product or access to it;
- (b) copy, reproduce, republish, or distribute any Content except as expressly permitted for the User's own personal use;
- (c) reverse engineer, decompile, disassemble, modify, or create derivative works from any Product or its software; or
- (d) use any Product or Content to develop or train any competing product, service, or model.
A.5 Intellectual Property
As between the parties, MHM and its licensors own and retain all right, title, and interest, including all intellectual property rights, in and to the Products, the Content, and all trademarks, service marks, trade names, logos, and branding. Except for the limited license expressly granted in Section A.4, no right, title, or interest in or to the Products or the Content is granted or transferred to the User, whether by implication, estoppel, or otherwise. All rights not expressly granted are reserved by MHM.
A.6 User Accounts and User Content
Where a Product accesses the User's own accounts and storage, all content the User creates, uploads, enters, or stores within the User's own accounts remains the property of the User. The User is solely responsible for:
- (a) the accuracy and legality of the information the User enters or stores;
- (b) maintaining the security of the User's own accounts, passwords, and devices; and
- (c) backing up the User's own records.
The records the User organizes using the Products may be highly sensitive, and the User is responsible for securing them. See Sections A.9 and B.10.
A.7 Purchases, Pricing, Payment, and Taxes
Prices for the Products are stated at the point of purchase and are subject to change. MHM processes payments through Stripe, its third-party payment processor. Payment is handled by Stripe under its own terms and privacy policy, and MHM does not receive or store the User's full payment card number. The User agrees to provide accurate and current payment information and authorizes the charge for the Product selected, together with any applicable taxes. The User is responsible for all taxes associated with the User's purchase, other than taxes based on MHM's net income.
A.8 Refunds
All sales of the digital Products are final. Because the Products deliver value immediately upon access, MHM does not offer refunds except as required by applicable law or as expressly stated below:
- (a) Future updates. Upon purchasing a Product, the User is entitled to future updates to that Product at no additional charge.
- (b) Chaos to Capable certificate. This is the sole exception to the "all sales final" policy. If a court does not accept the Chaos to Capable certificate of completion, MHM will refund the purchase price for that program in full upon request.
For assistance with any Product, the User may contact hello@mentalhealthmoves.com, and MHM will respond within two (2) business days.
A.9 Google Workspace, Google Drive, and Third-Party Services
Certain Products are built on Google Workspace and Google Apps Script and operate directly with the User's Google account and Google Drive. The following provisions apply:
- (a) Authorization. To use such Products, the User authorizes the Product through Google's authorization (OAuth) process. The Product requests only those Google permissions necessary to perform its function, such as permission to create folders and files in the User's Google Drive.
- (b) Location of records. Where a Product creates folders or enables the User to add documents, such folders and documents are created within the User's own Google Drive, under the User's own Google account. The User's records and documents are not stored on MHM's servers.
- (d) Third-party services. The Products and websites rely on third-party services, including Google, our payment processor (Stripe), our course-hosting platform, our credentialing provider, our analytics provider, and the social media platforms on which MHM maintains a presence. The User's use of such services is governed by the respective third party's terms and privacy policy, and MHM is not responsible for those services.
A.10 Acceptable Use
The User shall not use any Product, website, or social media channel to engage in any unlawful, abusive, infringing, or harmful activity, including, without limitation, attempting to gain unauthorized access to MHM's systems, interfering with the operation of any Product, or using any Product in a manner that violates the rights of any third party or any applicable law.
A.11 Disclaimer of Warranties
THE PRODUCTS, WEBSITES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, MHM DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MHM DOES NOT WARRANT THAT THE PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THEY WILL PRODUCE ANY PARTICULAR RESULT. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, AND ACCORDINGLY SOME OF THE FOREGOING EXCLUSIONS MAY NOT APPLY TO THE USER.
A.12 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MHM AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USER'S USE OF, OR INABILITY TO USE, ANY PRODUCT, WEBSITE, OR SOCIAL MEDIA CHANNEL, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT MHM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MHM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT THE USER PAID TO MHM FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT PERMIT CERTAIN LIMITATIONS OF LIABILITY, AND ACCORDINGLY SOME OF THE FOREGOING LIMITATIONS MAY NOT APPLY TO THE USER.
A.13 Indemnification
The User shall indemnify, defend, and hold harmless MHM and its members, managers, officers, employees, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the User's misuse of any Product, the User's breach of this Agreement, or the User's violation of any applicable law or the rights of any third party.
A.14 Dispute Resolution; Arbitration; Class-Action Waiver; Governing Law
The User should read this Section carefully. It affects how disputes between the User and MHM are resolved and includes a waiver of class actions.
- (a) Governing law. This Agreement is governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles.
- (b) Informal resolution. Before commencing any formal proceeding, the User agrees to contact MHM at hello@mentalhealthmoves.com and to allow MHM thirty (30) days to resolve the dispute informally.
- (c) Binding arbitration. Except as provided below, any dispute arising out of or relating to this Agreement or the Products that is not resolved informally shall be resolved by final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer arbitration rules, rather than in court. The seat of the arbitration shall be the State of Wyoming; the location and format of any hearing shall be determined under those rules, which provide for proceedings reasonably accessible to the User.
- (d) Small-claims exception. Either party may bring an individual claim in a small-claims court of competent jurisdiction if the claim qualifies.
- (e) Class-action waiver. All disputes shall be resolved on an individual basis only. The User and MHM each waive any right to bring or participate in any class, collective, consolidated, or representative action.
- (f) Right to opt out. The User may opt out of the arbitration provisions of this Section by sending written notice to hello@mentalhealthmoves.com within thirty (30) days of first accepting this Agreement, stating the User's election to opt out of arbitration. If the User opts out, any dispute shall be resolved exclusively in the state or federal courts located in the State of Wyoming, and the User and MHM consent to the personal jurisdiction and venue of those courts.
A.15 Modifications to this Agreement
MHM reserves the right to modify this Agreement at any time. When MHM does so, it will revise the "Last Updated" date above and post the revised Agreement. For material changes, MHM will provide notice to the User by email to the address associated with the User, where one is available, and by posting the revised Agreement. The User's continued use of any Product after the effective date of a revised Agreement constitutes acceptance of the revised Agreement.
A.16 Term, Termination, and Survival
This Agreement applies for so long as the User accesses or uses any Product. MHM may suspend or terminate the User's access to any Product if the User breaches this Agreement. The following Sections survive termination: A.5 (Intellectual Property), A.8 (Refunds), A.11 (Disclaimer of Warranties), A.12 (Limitation of Liability), A.13 (Indemnification), A.14 (Dispute Resolution; Arbitration; Class-Action Waiver; Governing Law), A.17 (General Provisions), and Part B (Privacy Notice).
A.17 General Provisions
- (a) Entire agreement. This Agreement constitutes the entire agreement between the User and MHM regarding the Products and supersedes all prior or contemporaneous understandings, agreements, representations, and communications, whether written or oral, on the subject matter hereof.
- (b) Severability. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
- (c) No waiver. No failure or delay by MHM in exercising any right under this Agreement shall constitute a waiver of that right, and no waiver shall be effective unless made in writing.
- (d) Assignment. The User may not assign or transfer this Agreement or any rights or obligations hereunder without MHM's prior written consent. MHM may freely assign this Agreement, including in connection with a merger, acquisition, reorganization, or sale of assets. By accepting this Agreement, the User expressly consents to the transfer of the User's personal information in connection with any such transaction. Any successor entity will be required to honor the commitments made in this Privacy Notice with respect to the User's personal information.This Agreement binds and inures to the benefit of the parties and their permitted successors and assigns.
- (e) Notices. MHM will provide notices to the User by email to the address associated with the User, where one is available, and may additionally post notices through the Products or websites. Notice of material changes to this Agreement will be given as provided in Section A.15. The User shall provide notices to MHM in writing at hello@mentalhealthmoves.com.
- (f) Electronic communications. The User consents to receive communications from MHM in electronic form, and the User agrees that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
- (g) Force majeure. MHM shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, governmental action, failures of third-party services or infrastructure, and interruptions of the internet or telecommunications.
- (h) No third-party beneficiaries; relationship. This Agreement does not create any third-party beneficiary rights. Nothing in this Agreement creates any partnership, joint venture, agency, or employment relationship between the parties.
- (i) Headings. Headings are for convenience only and do not affect the interpretation of this Agreement.
